O-1 Visa Cases: Persons of Extraordinary Ability in the Arts, Sciences, Business or Athletics.

SCIENCES: Neurologist, specializing in Parkinson’s Disease. On behalf of this major New York City hospital, we successfully petitioned the BCIS to grant O-1 visa status to this outstanding French researcher. The researcher had been a J-1 visa holder and subject to the 2-year foreign residency requirement. The O-1 visa status enabled him to work in the U.S. for an additional three years before leaving the U.S. to fulfill his foreign residency requirement. We submitted copies of his B.S., M.S., Ph.D. and M.D. diplomas, articles which he authored and published in internationally-renowned scientific journals, confirmation of his membership in scientific associations, documentation that he was a presenter at international symposia, as well as numerous letters from experts attesting to the Beneficiary’s extraordinary scientific research.

ARTS: Photographer. We obtained an O-1 visa on behalf of a prestigious photography studio for a Photographer of international renown. We submitted copies of magazine covers and internal pages in which the Beneficiary’s photographs appeared in his home country, copies of chapters of books in showing the Beneficiary’s photographs and many letters of experts confirming the Beneficiary’s expertise. In addition, we submitted documentation on the success of the Petitioning photography studio, including evidence that the studio’s clients included top international fashion design firms, as well as internationally-distributed magazines and newspapers. This was necessary to prove that the studio required the services of an extraordinary photographer.

Understudy for the Lead Role in a Long-Running Broadway Show
We successfully represented this actor/singer/dancer who performed the lead role in a hit Broadway show over 100 times.

We successfully represented a folk singer/songwriter who had obtained national acclaim in his native Australia.

Ballet Dancer
We successfully demonstrated to the BCIS that this 19-year-old ballet dancer had reached the very top of his field.

We successfully represented this high-tech computer expert by demonstrating that he has reached the very top of this global, expanding field. [Interesting note: we obtained an Approval on this self-petition, despite the BCIS unreasonable request that we prove that our client was "like Bill Gates." The BCIS accepted our explanation that even Bill Gates "isn’t" Bill Gates, in that Mr. Gates is famous for having achieved not only technological expertise, but also for running one of the world’s most successful companies Microsoft. As our client was a technologist and not a businessman, this was not the correct standard to which he should be held.]

Pharmacological Opioid and Receptor Researcher
We successfully demonstrated that this Ph.D. holder, a Pharmacological Opioid and Receptor Researcher is one of the few scientists who has reached the very top of his field.

Biostatistics Scientist
We successfully demonstrated that this Ph.D. holder, a Biostatistics Scientist, is at the very top of her field.

We successfully obtained a National Interest waiver of the requirement of a job offer for this Ph.D. holder, a Hematopoietic Stem Cell Biology Researcher whose work is instrumental in developing cures for severe blood disorders including leukemia and HIV.

Phone Card Distribution Company Founder
We successfully obtained a National Interest waiver of the requirement of a job offer for this businessman who started up a phone card distribution company.

Accountant
We successfully obtained a National Interest waiver of the requirement of a job offer for this Accountant. We submitted evidence that, in this time of globalization, it is in the National Interest of the United States to grant this individual U.S. permanent residence status so that our country may make use of his dual fluencies in the accounting systems of both the U.S. and his native country.

We successfully represented this Russian journalist who continued to write truthfully and accurately despite threats to her life, and convinced the BCIS that the presence of such a strong, independent-minded journalist is, indeed, in the National Interest of the United States.
