Notable Cases


EB-1 - Immigration approved the EB-1 green card case we filed for Squash Player Alister Walker, Ranked #20 in the world. Previously we obtained EB-1 green cards for Squash Players from India, England, South Africa & Australia, and we will file an EB-1 petition for a top-ranked Squash Player from Pakistan in the next few weeks.

EB-1: Extraordinary Ability in the Arts, Sciences, Business, Education or Athletics. Over the past 15+ years, our law office has been fortunate to file many successful EB-1 petitions for top research scientists, fashion designers, musicians, models, etc. These individuals typically have received top honors, including Emmys for TV production, Gold and Silver Promax Awards for top promos and motion graphics, major awards from international scientific associations, etc. The cases below are a sample of our notable successes. In each case, either the profession is unusual ('Classical Music Whistler' or 'Research Scientist Specializing in Female Spider Genitalia') or the opposite, the field is extremely common (clothing designer, musician, computer programmer). In the first instance, we had to prove that individual is part of a 'field' rather than someone with a unique skill, while in the latter, we had to prove that the individual had risen to the very top of that very broad field.

EB-1: Extraordinary Ability in the Sciences Research Scientist, Chronic Pain Management. We obtained a Green Card for this research scientist, who had come to our office looking for a J-1 visa, which would have only provided him with temporary status.However, upon reviewing his credentials, we asked him if he was interested in permanent residence, and he was shocked that he could qualify. It is our experience that many of the most-qualified scientists do not realize that they are able to self-petition for Green Cards, as they are only too-aware of the very high goals they have set for themselves, and that they have not yet achieved those goals. However, their accomplishments are already far-superior to their peers, and often they are so advanced that they qualify for self-sponsorship, so they don't even require an employer to sponsor them. This was one of those cases. We obtained a Green Card for this Research Scientist

EB-1: Research Scientists, Cancer. We obtained a Green Card for this Researcher in the field of emergency medicine after she had been told by other immigration lawyers that she didn't qualify for EB-1 Extraordinary Ability. We proved that this researcher Extraordinary Ability in the Arts Fashion Designer, Popular Designs with an International Design House We obtained a Green Card for this Fashion Designer on first submission, without need for additional documentation. She worked as one of the many "unnamed" and unheralded designers for a major international design house, whose brand is the name of the Designer, himself. Despite having virtually no published material at all in the Fashion Designers own name, the case was approved by Immigration.

EB-1: Fashion Designer, Popular Designs for a Major Retail Chain. We obtained a Green card for this Fashion Designer who designs for a major mid-price retailer, with retail stores throughout the country, all in their name brand, with no mention of this designer. Despite the designer?s name appearing virtually nowhere in print or on-line, Immigration approved the case.

EB-1: Fashion Designer, Niche Market. We obtained a Green Card for this self-petitioning 23-year-old Fashion Designer who started his own men's fashion line in Brazil for the gay male population. We documented the Designer's extraordinary success through a variety of evidence. This case was approved on first submission without need to provide additional evidence, despite the fact that the Designer was still in F-1 OPT status in the U.S.

EB-1: Graphic Artist, Multi-media. We obtained a Green Card for this graphic designer while he was still a student at M.I.T. in F-1 OPT status. We were able to demonstrate his national and international success through evidence of the impact of his graphic designs on the field of international design, and through his presentations at the U.N. We obtained a Green Card for this 23-year-old Stylist, who had been the Stylist for numerous ad spreads in major magazines for national and international brands.

EB-1: Musician, Bass Player. We obtained a Green Card for this Bass Player for a popular foreign singer. Immigration required additional documents to prove the national or international success of the Bass Player, whose reputation was based on his playing for famous singers and bands, but whose own name was unknown to the general population. We were able to prove that he was, nevertheless, "one of the few individuals to reach the top of the field" through alternative documentation.

EB-1: Classical Music Whistler. We obtained a Green Card for this artist whose skill is whistling classical music. Immigration acknowledged that the musician had a very special skill, but requested additional documentation that the skill is not unique, but rather, that there is actually a field of individuals with this skill. We proved that this musician was the president of a national music whistler's association (although the association had only 10 members nationwide), and Immigration quickly approved the case.

EB-1: Colored Pencil Artist. We obtained a Green Card for this artist who works solely with colored pencils. Despite never selling a piece of art, we were able to prove that this artist was, indeed, at the top of her field. We obtained a Green Card for this "artist" & an instructor of professional magicians/close-up magician and inventor of magic tricks.

EB-1: Producers, Motion Graphics for Commercials. We obtained Green Cards for several "Motion Graphics" professionals, whose unique, compelling and innovative motion graphics designs for nationally-broadcast commercials, promos feature films and TV stations and programs placed them at the top of the field.

EB-1 : Extraordinary Ability in Athletics. We have obtained Green Cards for many squash players who are among the top-ranked players in singles and doubles squash from South Africa, England, India, and Ireland.

H-1B : We obtained an H-1B Approval where the Beneficiary is the sole employee of a new company. To win, we needed to be innovative: we showed a company bank statement with sufficient funds for overhead and the salary. We also provided a detailed "Employee Performance Review" form that the off-site employer will use to supervise her. The case was approved in 1 week.

EB-1 Green Card : We obtained an EB-1 Green Card for a Motion Graphics Designer who creates cutting-edge motion graphics for promos for top-rated cable TV networks, TV shows & commercials. The case was well-documented with videos of the promos, national awards and articles in the NY Times and other major media. We love his promos & are thrilled that his green card will provide him with the independence he needs as an artist.

O-1 visa : Our law office received Approval on an O-1 visa petition for a 25-yr old Sous-Chef. The case is noteworthy b/c of the lack of published material about the Chef. The primary evidence consisted of the offer of employment & letters from prior employers confirming the Chef's expertise and experience. We worked diligently to ensure those letters contained sufficient information to enable Immigration to approve the case.
